We reserve the right, in our sole discretion, to update or revise these Terms of Use. Your continued use of the site following the posting of any changes to the Terms of Use constitutes acceptance of those changes. When you purchase items on our site you enter into a binding agreement which is governed by the Terms of Use.

The Terms and Conditions of using www.afrosense.co.za and all associated services are outlined in this Agreement (the “Agreement”).

These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”).

If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask Afro Sense to explain it to you before you accept the Terms of Use or continue using the Website.

Nothing in these Terms of Use is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or Afro Sense in terms of the CPA.

Afro Sense permits the use of this Website subject to the Terms of Use. By using this Website in any way, you shall be deemed to have accepted all the Terms of Use unconditionally. You must not use this Website if you do not agree to the Terms of Use.

The Website enables you to shop online for beauty products (“Goods”).

Please read this agreement carefully before proceeding. Under this Agreement, the payment processing services for the goods purchased on this website are provided by Afro Sense, depending on the type of payment method used to purchase the goods.

1. Product Pricing:

Final checkout prices shown are inclusive of taxes and delivery and are representative of the total that you will pay for the ordered Product. You agree to pay the shown price for the products selected.

Afro Sense reserves the right to change prices at any time until such a time as they issue an “Acceptance of Order” notice. If the total price differs to what was shown at checkout you reserve the right to ask for a full refund instead of paying the difference. Your Order remains valid as an offer until we issue our Acceptance of Order. We shall not be under any obligation to supply the Product to you until we have accepted your Order. Unless expressly stating that we accept your order, an email, letter, fax or other Confirmation of your Order by us is purely for information purposes and does not constitute the Acceptance of Order. Delivery of the Order also constitutes the Acceptance of Order.

We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of Goods on the Website. However, should there be any errors of whatsoever nature on the Website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.

You shall pay for the Product in full at the time of ordering by supplying us with your credit or debit card details from a credit card company acceptable to us, which we require in order to process your Order. Alternatively, you may pay by any method that we have said is acceptable to us, but in any event we shall not be bound to supply before we have received cleared funds in full. We reserve the right to perform a credit check and to reject/not to offer certain forms of payment and to refer you to our other forms of payment.

We may ask for further proof that you are fully entitled to use a card (or other form of payment) that you have used to purchase the Products before releasing your Product.

It is your responsibility to ensure that all details you have supplied us are correct and continue to be accurate. Any costs that may arise out incorrect details will be for the Customer’s account.

If you realize that you have made a mistake with your Order after you have completed the checkout process, please contact info@rafrosales.co.za immediately. However, we cannot guarantee that we will be able to accept any changes to your Order in accordance with your instructions.

In cases where there is more than one item on your Order, we reserve the right not to supply some Items that make up your complete Order. In such a case we will only refund you for the items that are not available.

2. Reviews and Comments

Except otherwise provided elsewhere in this Agreement or on the site, anything that you submit or post to Afro Sense, including, without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively, “Submissions”) will be treated as non-confidential and non-proprietary, and by submitting or posting, you agree to irrevocably license the entry and all IP rights related thereto (excluding the moral rights such as authorship right) to Afro Sense without charge, and Afro Sense shall have royalty-free usage rights.

You shall not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead Afro Sense or third parties as to the origin of any Submissions or Content. Afro Sense may, but shall not be obligated to remove or edit any Submissions (including comments or reviews) for any reason.

All text, graphics, photographs or other images, button icons, audio clips, logos, slogans, trade names or word software and other contents on the website of Afro Sense (collectively, “Content”), belongs exclusively to Afro Sense or its appropriate content suppliers. All rights not expressly granted are reserved by Afro Sense. Violators will be prosecuted to the full extent of the law.

3. Payment

We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

Whether the Goods are for sale by Afro Sense or a Third Party Seller, payment can be made for Goods via –

  • debit card;
  • credit card: where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the Goods. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;
  • Instant EFT;
  • Cash on delivery; by selecting this option, you undertake to ensure that you have the exact cash on hand at the time of delivery.

Once you have selected your payment method (save for cash on delivery or direct bank deposit), you will be directed to a link to a secure site for payment of the applicable purchase price for the Goods.

4. Delivery of goods

Afro Sense offers 2 (two) methods of delivery of Goods to you. You may select delivery via:

  • courier; or
  • self-collection

Where it accepts your order, Afro Sense will deliver the Goods to you as soon as reasonably possible, but no later than 7 (seven) days of receipt of your payment (“Delivery Period”). We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within 7 (seven) days of receiving such notification elect whether or not to cancel your order for the Goods. If you elect to cancel your order, we will reimburse you for the purchase price.

Afro Sense’s obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for delivery of the order. Afro Sense is not responsible for any loss or unauthorised use of a product, after it has delivered the product to the physical address nominated by you.

Afro Sense will arrange with you in advance when your order will be collected. Self- collection is only for the Johannesburg and Pretoria area. If a collection time has been arranged and for whatever reason you are not at the delivery location as arranged, you will be charged an additional delivery fee should you require delivery to be at a later time/ location.

You can choose to collect from the following locations in Johannesburg and Pretoria:

  • Soweto (Jabulani Mall) – Saturdays
  • Johannesburg CBD- Wednesdays and Fridays
  • Pretoria CBD – Tuesdays and Thursdays

Collection hours: Weekdays between 10h00 and 20h00, Weekends between 11h00 and 17h00

Standard Shipping:

  • Standard Shipping: R85.00 Delivery fee for Main Areas within SA
  • Surcharges for outlying areas will be applicable

*Standard shipping- delivered within 2 business days

6. Account Responsibility

Except for Afro Sense errors, you are responsible for all the actions of your account, including, but not limited to, the online signing of various agreements, posting, purchasing goods and services, and disclosing information.

7. Routine Maintenance Instructions

If you find any unauthorized use of your account to sign in to the Afro Sense platform or other situation that may cause your account to be stolen or lost, we recommend that you notify us immediately for processing. You understand that any action taken by Afro Sense takes a reasonable amount of time and Afro Sense action at your request may not be able to prevent or prevent the formation or expansion of the consequences of infringement. Afro Sense is not liable unless Afro Sense makes a legal.
